Ba\u011f-Kur&#8217;lu k\u00fc\u00e7\u00fck esnaf da prim g\u00fcn say\u0131s\u0131n\u0131n SSK&#8217;l\u0131 \u00e7al\u0131\u015fanla e\u015fitlenmesini bekliyor. Kelam konusu erken emeklilik i\u00e7in Ba\u011f-Kur prim g\u00fcn say\u0131s\u0131n\u0131n 9 binden 7 bin 200&#8217;e inmesi gerekiyor. B\u00f6ylece esnaf\u0131n 5 y\u0131l erken emekli olmas\u0131 sa\u011flanacak. CHP&#8217;li Akay, bir g\u00fcnle ma\u011fdur olanlar i\u00e7in kademeli emeklilik ve ikinci &#8216;EYT&#8217; olarak tan\u0131mlanan prim say\u0131s\u0131n\u0131n d\u00fc\u015fmesi i\u00e7in haz\u0131rlad\u0131\u011f\u0131 kanun teklifini TBMM&#8217;ye sundu. G\u00f6zler TBMM&#8217;den \u00e7\u0131kacak kararda&#8230;<\/p>\n<p><b>KANUN TEKL\u0130F\u0130 VER\u0130LD\u0130<\/b><\/p>\n<p>CHP Karab\u00fck Milletvekili Cevdet Akay, memur ve esnaf\u0131n emeklilik i\u00e7in gerekli prim g\u00fcn say\u0131s\u0131n\u0131n 9000\u2019den 7200\u2019e d\u00fc\u015f\u00fcr\u00fclmesi ve 8 Eyl\u00fcl 1999 &#8211; 16 Nisan 2008 ortas\u0131nda sigortal\u0131 olanlara kademeli emeklilik imkan\u0131 tan\u0131nmas\u0131n\u0131 \u00f6ng\u00f6ren kanun teklifini TBMM\u2019ye sundu.<\/p>\n<p>TBMM Plan B\u00fct\u00e7e Komitesi \u00dcyesi ve CHP Karab\u00fck Milletvekili Cevdet Akay, taraf\u0131ndan haz\u0131rlanan Toplumsal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu ile T\u00fcrkiye Cumhuriyeti Emekli Sand\u0131\u011f\u0131 Kanunu\u2019nda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun Teklifi\u2019ni TBMM Ba\u015fkanl\u0131\u011f\u0131\u2019na sundu.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/ikimisli.tr\/wp-content\/uploads\/2025\/06\/son-dakika-binlerce-kisi-bekliyor-kademeli-ve-erken-emeklilikte-yeni-gelisme-kanun-teklifi-verildi-7hWdNMDy.jpg\"\/><\/p>\n<p><b>KADEMEL\u0130 EMEKL\u0130L\u0130K DE KANUN TEKL\u0130F\u0130NE EKLEND\u0130<\/b><\/p>\n<p>Teklifte, 8 Eyl\u00fcl 1999 ile 16 Nisan 2008 tarihleri ortas\u0131nda sigortal\u0131 olmu\u015f vatanda\u015flar\u0131n kademeli ge\u00e7i\u015fle emekli olabilmesinin sa\u011flanmas\u0131 ile prim g\u00fcn \u00f6deme say\u0131s\u0131 9000 olan esnaf ile memurlar\u0131n prim g\u00fcn \u00f6deme say\u0131s\u0131n\u0131n 7200\u2019e d\u00fc\u015f\u00fcr\u00fclmesi \u00f6ng\u00f6r\u00fcld\u00fc.<\/p>\n<p><b>&#8220;B\u0130R G\u00dcN FARKLA 20 YIL E\u015e\u0130TS\u0130ZL\u0130K DO\u011eURDU&#8221;<\/b><\/p>\n<p>Sosyal Sigortalar Kanunu&#8217;nda yap\u0131lan de\u011fi\u015fikliklerin toplumsal g\u00fcvenlik a\u00e7\u0131s\u0131ndan \u00f6l\u00e7\u00fcl\u00fcl\u00fck unsuruyla ba\u011fda\u015fmayan ve sigortal\u0131lar a\u00e7\u0131s\u0131ndan e\u015fitsiz bir durum yaratt\u0131\u011f\u0131na dikkat \u00e7eken Akay, &#8220;Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\u2019nda yap\u0131lan de\u011fi\u015fiklikle, ayl\u0131\u011fa hak kazanma \u015fartlar\u0131na ya\u015f \u015fart\u0131 da getirilmi\u015ftir. 08\/09\/1999 tarihinden bir g\u00fcn evvel i\u015fe ba\u015flayan \u00e7al\u0131\u015fanlar ile bir g\u00fcn sonra i\u015fe ba\u015flayan \u00e7al\u0131\u015fanlar ortas\u0131nda 17-20 y\u0131l fazla \u00e7al\u0131\u015fma m\u00fcddeti olmas\u0131 b\u00fcy\u00fck bir e\u015fitsizlik do\u011furmu\u015ftur. Ayr\u0131yeten, 1 May\u0131s 2008\u2019den sonra i\u015fe ba\u015flayan memurlar ile esnaflar\u0131n prim g\u00fcn say\u0131s\u0131n\u0131n 9000 olmas\u0131 da b\u00fcy\u00fck bir adetsizlik yaratm\u0131\u015ft\u0131r&#8221; dedi.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/ikimisli.tr\/wp-content\/uploads\/2025\/06\/son-dakika-binlerce-kisi-bekliyor-kademeli-ve-erken-emeklilikte-yeni-gelisme-kanun-teklifi-verildi-QceNTTFm.jpg\"\/><\/p>\n<p>Kanun teklifi hakk\u0131nda bilgi veren Akay, &#8220;TBMM Ba\u015fkanl\u0131\u011f\u0131\u2019na sundu\u011fumuz kanun teklifiyle, memur ve esnaflar\u0131n 9000 g\u00fcn olan prim g\u00fcn \u00f6deme say\u0131s\u0131n\u0131n 7200\u2019e d\u00fc\u015f\u00fclmesi ve 08.09.1999 ile 16.04.2008 tarihleri ortas\u0131nda sigortal\u0131 olmu\u015f vatanda\u015flar\u0131m\u0131z\u0131n kademeli ge\u00e7i\u015fle emekli olabilmeleri i\u00e7in bu d\u00fczenleme \u00f6nerilmi\u015ftir. Sundu\u011fumuz kanun teklifi, e\u015fitlik unsuru do\u011frultusunda haz\u0131rlanm\u0131\u015f ve t\u00fcm e\u015fitsizlikleri ortadan kald\u0131racak niteliktedir&#8221; s\u00f6zlerini kulland\u0131.<\/p>\n<p>Teklifin genel m\u00fcnasebetinde \u015fu s\u00f6zlere yer verildi:<\/p>\n<p>&#8220;4447 say\u0131l\u0131 Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girmesinden sonra birinci kez sigortal\u0131 olan ve 4447 say\u0131l\u0131 Kanunun ge\u00e7i\u015f kararlar\u0131ndan yararlanamayan \u00e7al\u0131\u015fanlar\u0131n ya\u015f \u015fart\u0131 ve prim \u00f6deme g\u00fcn say\u0131s\u0131n\u0131n direkt bayanlarda 58 ve erkeklerde 60 ya\u015f ve 9000 g\u00fcn prim \u00f6deme g\u00fcne y\u00fckseltilmesi nedeniyle emeklili\u011fine ait ya\u015fad\u0131klar\u0131 adaletsizli\u011fin bir nebze olsun d\u00fczeltilmesi sa\u011flanmakta; 5510 say\u0131l\u0131 Kanunun emeklili\u011fe ait d\u00fczenlemelerinin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi 17\/4\/2008 tarihine kadar olan m\u00fcddette sigortal\u0131 olmu\u015f olan emek\u00e7ilere bir kademeli emeklilik d\u00fczenlemesi yap\u0131lmakta ve bunlara ait ya\u015f ve prim \u00f6deme g\u00fcn m\u00fcddetleri d\u00fczenlenmektedir.<\/p>\n<p>Di\u011fer yandan, farkl\u0131 stat\u00fclerdeki sigortal\u0131lar a\u00e7\u0131s\u0131ndan emeklili\u011fe hak kazanma a\u00e7\u0131s\u0131ndan prim \u00f6deme g\u00fcn kaidesindeki farkl\u0131l\u0131kta da bir ayr\u0131mc\u0131l\u0131k olmas\u0131 nedeniyle kanunla e\u015fitlenmi\u015f ve 5510 say\u0131l\u0131 Kanun ile Emekli Sand\u0131\u011f\u0131 Kanununda t\u00fcm sigortal\u0131lar a\u00e7\u0131s\u0131ndan fiili olarak prim \u00f6deme g\u00fcn say\u0131s\u0131 7200 g\u00fcn olarak tekrar d\u00fczenlenmi\u015ftir. Bu \u00e7er\u00e7evede de ge\u00e7i\u015f a\u00e7\u0131s\u0131ndan fiili pirim \u00f6deme g\u00fcn say\u0131s\u0131 ve hizmet y\u0131l\u0131 a\u00e7\u0131s\u0131ndan d\u00fczenlemeler yap\u0131lm\u0131\u015ft\u0131r. Teklifimizle, kademeli olarak emeklilik hakk\u0131 kazanmalar\u0131 ve olu\u015fan ma\u011fduriyetlerin giderilmesi ama\u00e7lanmaktad\u0131r.&#8221;<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/ikimisli.tr\/wp-content\/uploads\/2025\/06\/son-dakika-binlerce-kisi-bekliyor-kademeli-ve-erken-emeklilikte-yeni-gelisme-kanun-teklifi-verildi-TH3qj5lz.jpg\"\/><\/p>\n<p>Teklifin unsurlar\u0131 ise \u015f\u00f6yle:<\/p>\n<p>\u201cMadde 1- 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Toplumsal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanununun 27\u2019inci unsuru a\u015fa\u011f\u0131daki bi\u00e7imde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>&#8220;Mal\u00fbll\u00fck ayl\u0131\u011f\u0131n\u0131n hesaplanmas\u0131, ba\u015flang\u0131c\u0131, kesilmesi ve yine ba\u011flanmas\u0131<\/p>\n<p>Madde 27- Mal\u00fbll\u00fck ayl\u0131\u011f\u0131; prim g\u00fcn say\u0131s\u0131 7200 g\u00fcnden az olan sigortal\u0131lar i\u00e7in 7200 g\u00fcn \u00fczerinden, 7200 g\u00fcn ve daha fazla olanlar i\u00e7in ise toplam prim \u00f6deme g\u00fcn say\u0131s\u0131 \u00fczerinden, 29 uncu unsur kararlar\u0131na nazaran hesaplan\u0131r. Sigortal\u0131 di\u011fer birinin daima bak\u0131m\u0131na muhta\u00e7 ise tespit edilen ayl\u0131k ba\u011flama oran\u0131 10 puan art\u0131r\u0131l\u0131r. Mal\u00fbll\u00fck ayl\u0131\u011f\u0131, 4\u2019\u00fcnc\u00fc unsurun birinci f\u0131kras\u0131n\u0131n (a) ve (b) bentleri kapsam\u0131ndaki sigortal\u0131lar ile (c) bendi kapsam\u0131nda sigortal\u0131 iken misyonundan ayr\u0131lm\u0131\u015f ve daha sonra di\u011fer bir sigortal\u0131l\u0131k haline tabi olarak \u00e7al\u0131\u015fmam\u0131\u015f olanlar\u0131n; a) Mal\u00fbl say\u0131lmas\u0131na temel tutulan rapor tarihi yaz\u0131l\u0131 istek tarihinden evvel ise yaz\u0131l\u0131 istek tarihini, b) Mal\u00fbl say\u0131lmas\u0131na temel tutulan rapor tarihi yaz\u0131l\u0131 istek tarihinden sonra ise rapor tarihini, c) 4\u2019\u00fcnc\u00fc hususun birinci f\u0131kras\u0131n\u0131n (c) bendi kapsam\u0131nda \u00e7al\u0131\u015fmakta olanlar\u0131n ise, mal\u00fbliyetleri sebebiyle misyonlar\u0131ndan ayr\u0131ld\u0131klar\u0131 tarihi, takip eden ay ba\u015f\u0131ndan itibaren ba\u015flar. Mal\u00fbll\u00fck ayl\u0131\u011f\u0131 almakta iken bu Kanuna nazaran yahut yabanc\u0131 bir \u00fclke mevzuat\u0131 kapsam\u0131nda \u00e7al\u0131\u015fmaya ba\u015flayanlar\u0131n mal\u00fbll\u00fck ayl\u0131klar\u0131, \u00e7al\u0131\u015fmaya ba\u015flad\u0131klar\u0131 tarihi takip eden \u00f6deme devri ba\u015f\u0131nda kesilir ve bu Kanuna tabi olarak \u00e7al\u0131\u015ft\u0131klar\u0131 m\u00fcddet zarf\u0131nda 80\u2019inci hususa nazaran belirlenen prime temel \u00e7\u0131karlar\u0131 \u00fczerinden 81 inci unsur yeterince k\u0131sa ve uzun vadeli sigorta kollar\u0131 ile genel s\u0131hhat sigortas\u0131na ili\u015fkin prim al\u0131n\u0131r. Bunlardan i\u015ften ayr\u0131larak yine mal\u00fbll\u00fck ayl\u0131\u011f\u0131 ba\u011flanmas\u0131 i\u00e7in yaz\u0131l\u0131 istekte bulunan ya da emekliye ayr\u0131lan yahut sevk edilenlere; denetim muayenesine tabi tutulmak ve birinci ayl\u0131\u011f\u0131na temel mal\u00fbll\u00fc\u011f\u00fcn\u00fcn devam etti\u011fi anla\u015f\u0131lmak kayd\u0131yla, 4\u2019\u00fcnc\u00fc hususun birinci f\u0131kras\u0131n\u0131n (c) bendi kapsam\u0131nda \u00e7al\u0131\u015f\u0131yorsa misyonundan ayr\u0131ld\u0131\u011f\u0131 tarihi, ba\u015fkalar\u0131na ise istek tarihlerini takip eden \u00f6deme periyodundan itibaren yine mal\u00fbll\u00fck ayl\u0131\u011f\u0131 hesaplanarak ba\u011flan\u0131r.<\/p>\n<p>Bu durumdakilerden birinci ba\u011flanan mal\u00fbll\u00fck ayl\u0131\u011f\u0131na temel prim \u00f6deme g\u00fcn say\u0131s\u0131; a) 7200 g\u00fcn\u00fcn \u00fczerinde olanlar\u0131n ayl\u0131klar\u0131 30 uncu hususun \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (a) bendi kararlar\u0131 uygulanarak hesaplan\u0131r. b) 7200 g\u00fcnden az olanlar\u0131n ayl\u0131klar\u0131 ise, eski ayl\u0131\u011f\u0131n kesildi\u011fi tarihten sonra ayl\u0131klara yap\u0131lan art\u0131\u015flar uygulanmak suretiyle ayl\u0131\u011f\u0131n ba\u015flang\u0131\u00e7 tarihi itibariyle hesaplanan mebla\u011f\u0131n\u0131n emeklilik \u00f6ncesi ve sonras\u0131 prim \u00f6deme g\u00fcn say\u0131s\u0131 toplam\u0131n\u0131n emeklilik \u00f6ncesi prim \u00f6deme g\u00fcn say\u0131s\u0131na orant\u0131l\u0131 k\u0131sm\u0131 ile emeklilik sonras\u0131 \u00e7al\u0131\u015fmaya ili\u015fkin k\u0131smi ayl\u0131\u011f\u0131n toplam\u0131ndan olu\u015fur. Emeklilik sonras\u0131 \u00e7al\u0131\u015fmaya ili\u015fkin k\u0131smi ayl\u0131k, emeklilik \u00f6ncesi ve sonras\u0131 prim \u00f6deme g\u00fcn say\u0131s\u0131 toplam\u0131 ve emeklilik sonras\u0131 \u00e7al\u0131\u015fmaya ili\u015fkin prime temel yararlar\u0131 \u00fczerinden bu unsurun birinci f\u0131kras\u0131na nazaran hesaplanan ayl\u0131\u011f\u0131n emeklilik sonras\u0131 prim \u00f6deme g\u00fcn say\u0131s\u0131na orant\u0131l\u0131 k\u0131sm\u0131 kadard\u0131r. Yeni ayl\u0131k, eski ayl\u0131\u011f\u0131n kesildi\u011fi tarihten sonra ayl\u0131klara yap\u0131lan art\u0131\u015flar uygulanmak suretiyle bulunan fiyat\u0131n alt\u0131nda olamaz.&#8221;<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/ikimisli.tr\/wp-content\/uploads\/2025\/06\/son-dakika-binlerce-kisi-bekliyor-kademeli-ve-erken-emeklilikte-yeni-gelisme-kanun-teklifi-verildi-IArnfmr2.jpg\"\/><\/p>\n<p>Madde 2- 5510 say\u0131l\u0131 Kanunun 28\u2019inci unsurunun ikinci f\u0131kras\u0131n\u0131n (a) bendi a\u015fa\u011f\u0131daki formda de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>&#8220;a) Bayan ise 58, erkek ise 60 ya\u015f\u0131n\u0131 doldurmu\u015f olmalar\u0131 ve en az 7200 g\u00fcn mal\u00fbll\u00fck, ya\u015fl\u0131l\u0131k ve mevt sigortalar\u0131 primi bildirilmi\u015f olmas\u0131 kaidesiyle ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131 ba\u011flan\u0131r.\u201d<\/p>\n<p>Madde 3- 5510 say\u0131l\u0131 Kanunun s\u00fcreksiz 9\u2019uncu hususuna a\u015fa\u011f\u0131daki f\u0131kralar eklenmi\u015ftir.<\/p>\n<p>&#8220;8\/9\/1999 il\u00e2 30\/4\/2008 tarihlerinde; 17.07.1964 tarihli 506 say\u0131l\u0131 Kanun, 02.09.1971 tarihli 1479 say\u0131l\u0131 Kanun ve 17.10.1983 tarihli 2925 say\u0131l\u0131 Kanun kararlar\u0131na tabi olarak birinci kez sigortal\u0131 olup bu Kanunun 4&#8217;\u00fcnc\u00fc hususunun birinci f\u0131kras\u0131na nazaran sigortal\u0131 say\u0131lanlara ya\u015fl\u0131l\u0131k yahut emekli ayl\u0131\u011f\u0131 ba\u011flanmas\u0131 i\u00e7in bu hususun birinci, ikinci, \u00fc\u00e7\u00fcnc\u00fc ve d\u00f6rd\u00fcnc\u00fc f\u0131kralar\u0131n\u0131n sigortal\u0131n\u0131n lehine olan kararlar\u0131 hari\u00e7, ya\u015f ve emeklilik prim g\u00fcn say\u0131s\u0131 kaideleri a\u015fa\u011f\u0131daki formda uygulan\u0131r:<\/p>\n<p>1-a) 8\/9\/1999 il\u00e2 31\/12\/2000 tarihlerinde birinci kez sigortal\u0131 olan bayan i\u00e7in 49 ya\u015f, erkek i\u00e7in 51 ya\u015f ve her ikisi i\u00e7in 6525 prim g\u00fcn\u00fc, b) 1\/1\/2000 il\u00e2 31\/12\/2000 tarihlerinde birinci kez sigortal\u0131 olan bayan i\u00e7in 50 ya\u015f, erkek i\u00e7in 52 ya\u015f ve her ikisi i\u00e7in 6600 prim g\u00fcn\u00fc, c) 1\/1\/2001 il\u00e2 31\/12\/2001 tarihlerinde birinci kere sigortal\u0131 olan bayan i\u00e7in 51 ya\u015f, erkek i\u00e7in 53 ya\u015f ve her ikisi i\u00e7in 6675 prim g\u00fcn\u00fc, d) 1\/1\/2002 il\u00e2 31\/12\/2002 tarihlerinde birinci sefer sigortal\u0131 olan bayan i\u00e7in 52 ya\u015f, erkek i\u00e7in 54 ya\u015f ve her ikisi i\u00e7in 6750 prim g\u00fcn\u00fc, e) 1\/1\/2003 il\u00e2 31\/12\/2003 tarihlerinde birinci kez sigortal\u0131 olan bayan i\u00e7in 53 ya\u015f, erkek i\u00e7in 55 ya\u015f ve her ikisi i\u00e7in 6825 prim g\u00fcn\u00fc, f) 1\/1\/2004 il\u00e2 31\/12\/2004 tarihlerinde birinci kere sigortal\u0131 olan bayan i\u00e7in 54 ya\u015f, erkek i\u00e7in 56 ya\u015f ve her ikisi i\u00e7in 6900 prim g\u00fcn\u00fc, g) 1\/1\/2005 il\u00e2 31\/12\/2005 tarihlerinde birinci kez sigortal\u0131 olan bayan i\u00e7in 55 ya\u015f, erkek i\u00e7in 57 ya\u015f ve her ikisi i\u00e7in 6975 prim g\u00fcn\u00fc, h) 1\/1\/2006 il\u00e2 31\/12\/2006 tarihlerinde birinci kere sigortal\u0131 olan bayan i\u00e7in 56 ya\u015f, erkek i\u00e7in 58 ya\u015f ve her ikisi i\u00e7in 7050 prim g\u00fcn\u00fc, \u0131) 1\/1\/2007 il\u00e2 31\/12\/2007 tarihlerinde birinci sefer sigortal\u0131 olan bayan i\u00e7in 57 ya\u015f, erkek i\u00e7in 59 ya\u015f ve her ikisi i\u00e7in 7125 prim g\u00fcn\u00fc, i) 1\/1\/2008 il\u00e2 30\/4\/2008 tarihlerinde birinci kere sigortal\u0131 olan bayan i\u00e7in 58 ya\u015f, erkek i\u00e7in 60 ya\u015f ve her ikisi i\u00e7in 7200 prim g\u00fcn\u00fc.&#8221;<\/p>\n<p>Madde 4- 08\/06\/1949 tarihli ve 5434 say\u0131l\u0131 T\u00fcrkiye Cumhuriyeti Emekli Sand\u0131\u011f\u0131 Kanununa a\u015fa\u011f\u0131daki s\u00fcreksiz husus eklenmi\u015ftir.<\/p>\n<p>Ge\u00e7ici unsur 227- Bu kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihte;
