El koyma karar\u0131na kat\u0131lmayan bir hakim karar\u0131n alt\u0131na yazd\u0131\u011f\u0131 kar\u015f\u0131 oy yaz\u0131s\u0131nda, \u201cHer ne kadar \u0130\u00e7tihat Birle\u015ftirme Karar\u0131n\u0131n (\u0130BK) konusu \u00f6denmeyen t\u00fcketici kredileri nedeniyle emekli maa\u015f\u0131 \u00fczerine (takas, mahsup, virman vs.) blokaj konulmas\u0131 ise de kavram ve bahis bununla sonlu tutulamaz\u201d dedi.<\/p>\n<p><strong>HERKES \u0130\u00c7\u0130N GE\u00c7ERL\u0130<\/strong><\/p>\n<p>Hakim, \u201cOy \u00e7oklu\u011fuyla al\u0131nan karar nedeniyle, t\u00fcketici kredileriyle sonlu olmaks\u0131z\u0131n, ticari kredi \u00e7ekildi\u011finde, t\u00fcketici yahut ticari krediye kefil olundu\u011funda da emekli maa\u015f\u0131n\u0131n \u00fczerine bloke konulabilece\u011fini kabul etmek mecburili\u011fi do\u011fmaktad\u0131r. \u00d6teki bir anlat\u0131mla, bir sefer emekli maa\u015f\u0131n\u0131n tamam\u0131 \u00fczerine blokaj\/elkoyma m\u00fcmk\u00fcn denildi\u011finden, alaca\u011f\u0131n kayna\u011f\u0131 konusunda da bir s\u0131n\u0131rlama getirilemez\u201d g\u00f6r\u00fc\u015f\u00fcne yer verdi. Hakim, sabit gelirli fakirlerin maa\u015f\u0131na tefeciler taraf\u0131ndan nas\u0131l el konulaca\u011f\u0131n\u0131 da \u015f\u00f6yle lisana getirdi:<\/p>\n<p>\u201cAlacakl\u0131 bir tefeci bile olabilir. Kelam gelimi, yap\u0131lan bir ikrazat kontrat\u0131nda emekli bankadaki maa\u015f\u0131 \u00fczerine bloke konulmas\u0131n\u0131 kabul etmi\u015f ise, tefeci de kontrat\u0131n imzas\u0131 s\u0131ras\u0131nda ald\u0131\u011f\u0131 blokaj m\u00fcsaadesini bankaya sunarak, asla haczedemeyece\u011fi emekli maa\u015f\u0131 \u00fczerine bloke\/elkoyma ve \u2018kendi hesab\u0131na nakletme\u2019 hakk\u0131 verilmi\u015f olacakt\u0131r. Bankalara bu hak veriliyorsa, ba\u015fka alacakl\u0131lar taraf\u0131ndan bu sa\u011flanmaz denilmesi e\u015fitlik, hak ve adalet prensipleriyle ba\u011fda\u015fmayacakt\u0131r.\u201d<\/p>\n<p><strong>K\u0130RACILARIN MAA\u015eI DA <\/strong><strong>TEHL\u0130KE ALTINDA<\/strong><\/p>\n<p>Hakim kar\u015f\u0131 oy yaz\u0131s\u0131nda, i\u00e7tihat karar\u0131yla kiras\u0131n\u0131 \u00f6deyemeyen kirac\u0131lar\u0131n da maa\u015f\u0131na el konulabilece\u011fini bildirdi. Hakimin ikaz\u0131nda \u015fu s\u00f6zler yer ald\u0131: \u201cBir kira kontrat\u0131 s\u0131ras\u0131nda verilen blokaj m\u00fcsaadesi (tahliye taahh\u00fcd\u00fc ge\u00e7ersiz oldu\u011fu halde), bu karar sayesinde kira bedeli istikametinden kiralayana kirac\u0131n\u0131n emekli maa\u015f\u0131na blokaj\/el koyma imkan hak ve yetkisi verecektir.
