Y\u00f6netim Mahkemesi Kent Planc\u0131lar\u0131 Odas\u0131n\u0131n a\u00e7t\u0131\u011f\u0131 davay\u0131 karara ba\u011flad\u0131 ve 2\u2019si Kent Planc\u0131s\u0131, 1\u2019i \u0130n\u015faat M\u00fchendisi 3 ki\u015filik eksper heyeti raporuyla ke\u015fif tutanaklar\u0131nda bariz bi\u00e7imde imar tersli\u011fi tespit edildi\u011fine kanaat getirdi.<\/p>\n<p>Bilirki\u015fi raporunda, B\u00fcy\u00fck\u015fehir ve Kayap\u0131nar Belediyeleri Meclis karar\u0131yla onaylanan ve imar plan de\u011fi\u015fikli\u011fi ile eklenen \u201cOrtak alan niteli\u011findeki gezilebilen teraslar y\u00fczde 30 hesab\u0131na dahil edilmeksizin emsal harici tutulacakt\u0131r\u201d halindeki 3 no\u2019lu plan notunun 3194 say\u0131l\u0131 \u0130mar Kanunu Mekansal Planlar \u0130mal Y\u00f6netmeli\u011fine, plan b\u00fct\u00fcnl\u00fc\u011f\u00fcne, hizmet gereklerine, planlama ve \u015fehircilik prensiplerine b\u00fcsb\u00fct\u00fcn muhalif oldu\u011fu vurguland\u0131.<\/p>\n<p><b>G\u0130ZL\u0130 EMSAL OLU\u015eTURULDU KA\u00c7AK ALAN Y\u00dcZDE 60\u2019A \u00c7IKTI<\/b><\/p>\n<p>4. Y\u00f6netim Mahkemesi daval\u0131 B\u00fcy\u00fck\u015fehir ile Kayap\u0131nar Belediyesi ve Menduhe Durmaz\u2019\u0131n yaz\u0131l\u0131 savunmalar\u0131n\u0131 ald\u0131. Uzman raporunda tespit edilen imar usuls\u00fczl\u00fcklerini dikkate alan mahkeme heyeti z\u0131mn\u00ee emsal olu\u015fturuldu\u011funu, y\u00fczde 30\u2019luk b\u00e2t\u0131n emsal ile harici alanlar oran\u0131n\u0131n y\u00fczde 60\u2019lara kadar \u00e7\u0131kmas\u0131na sebebiyet verildi\u011finin alt\u0131n\u0131 \u00e7izdi.<\/p>\n<p><b>MAHKEME: \u015eAHSA \u00d6ZEL PLAN ADALETS\u0130ZL\u0130\u011eE YOL A\u00c7AR<\/b><\/p>\n<p>Ka\u00e7ak in\u015faat stat\u00fcs\u00fcndeki y\u00f6ntemsiz s\u00fcre\u00e7lerin \u0130mar y\u00f6netmeli\u011fine a\u00e7\u0131k\u00e7a terslik te\u015fkil etti\u011fini belirten mahkeme, meclis karar\u0131yla yap\u0131lan de\u011fi\u015fikli\u011fin kapal\u0131 in\u015faat alan\u0131n\u0131 art\u0131ran bir d\u00fczenleme oldu\u011funa vurgu yapt\u0131.<\/p>\n<p>Parselin kullan\u0131m emelinin ticaret+turizm oldu\u011fu da g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda bu yo\u011funluk art\u0131\u015f\u0131n\u0131n beraberinde bir trafik yo\u011funlu\u011fu da getirece\u011fini kaydedildi. Mahkeme, parsele \u201cKi\u015fiye \u00f6zel\u201d plan notu eklenmesinin ise emsal olu\u015fturacak kararlar\u0131n al\u0131nmas\u0131yla imar planlar\u0131n\u0131n uygulanmas\u0131nda haks\u0131z rekabete ve adaletsizli\u011fe sebebiyet verece\u011fini s\u00f6z etti.<\/p>\n<p><b>KAMUSAL FAYDA YOK, \u015eEH\u0130RC\u0130L\u0130K UNSURLARINA AYKIRI<\/b><\/p>\n<p>Mahkeme imar planlar\u0131n\u0131n kamu faydas\u0131 g\u00f6zetilerek haz\u0131rlanmas\u0131n\u0131n mecbur\u00ee oldu\u011funu, fakat dava konusu plan notu ile parsel \u00f6zelinde yap\u0131la\u015fma hakk\u0131n\u0131n artt\u0131r\u0131ld\u0131\u011f\u0131n\u0131 ve fiilen emsal art\u0131\u015f\u0131na yol a\u00e7\u0131ld\u0131\u011f\u0131na i\u015faret etti.<\/p>\n<p>Mahkeme, genel kamusal faydan\u0131n g\u00f6zetilmedi\u011fini Demirok \u0130n\u015faatta plan b\u00fct\u00fcnl\u00fc\u011f\u00fc a\u00e7\u0131s\u0131ndan e\u015fitsizlik ve haks\u0131z rekabet yarat\u0131ld\u0131\u011f\u0131n\u0131, m\u00fcnasebetiyle imar mevzuat\u0131nda belirtilen plan \u00fcretim tekniklerine, \u015fehircilik unsurlar\u0131na, planlama as\u0131llar\u0131na ve etraf imar b\u00fct\u00fcnl\u00fc\u011f\u00fcne uygunluk g\u00f6sterilmedi\u011fini belirtti.<\/p>\n<p>Mahkeme, B\u00fcy\u00fck\u015fehir ve Kayap\u0131nar Belediyesi Meclis karar\u0131yla yap\u0131lan imar plan de\u011fi\u015fikli\u011finde hukuka uyarl\u0131l\u0131k bulunmad\u0131\u011f\u0131ndan s\u00fcrecin oy birli\u011fiyle iptaline karar verdi.<\/p>\n<p>Mahkeme, yat\u0131r\u0131lan t\u00fcm har\u00e7lar, ke\u015fif bedeli, uzman fiyat\u0131 posta ve yarg\u0131lama sarfiyatlar\u0131 ile avukatl\u0131k fiyatlar\u0131n\u0131n de daval\u0131 kurumlardan al\u0131narak davac\u0131 kuruma \u00f6denmesini kararla\u015ft\u0131rd\u0131.<\/p>\n<p>Ka\u00e7ak stat\u00fcs\u00fcndeki ta\u015fk\u0131n in\u015faatla ilgili Etraf \u015eehircilik Vilayet M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce imar kirlili\u011fi, haks\u0131z rant olu\u015fturulmas\u0131yla ilgili 1\/1000\u2019lik imar plan\u0131na terslik te\u015fkil edildi\u011fi gerek\u00e7esiyle a\u00e7\u0131lan iptal davas\u0131 da 1.
